By accessing, browsing, or using the Website for any purpose whatsoever, you do so on the following terms and conditions:

I am participating voluntarily in a walking program (as an individual or as part of a corporate initiative) to improve my health and well-being and understand that the use of pedometers and the canamwalking.com online tracking tool are intended to provide information and behavior change motivation and are not designed for specific therapeutic or treatment purposes.
I hereby release and waive all liability against and agree to indemnify and save harmless all associated pedometer and Canamwalking.com manufacturers, owners, distributors and agents as well as my employer (where applicable) including affiliated owners, officers, directors and employees, of all the foregoing parties, from any liability, claims or cause of action of any sort, including injury sustained or arising directly or indirectly through my participation in any walking program or use of these products.
I agree that the use of the Website and related materials and/or products is at my own risk and that the canamwalking.com software and related services are for my personal and non-commercial use. I may not modify copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained therein.
I accept that the various tools provided within this software (e.g., BMI, Caloric intake, etc.) are for general information purposes only and are not intended to diagnose. Industry standard calculations offer general baseline information which may not be reflective of an individual's complete health profile or risk factors.
I understand that any personal contact data will not be used for the purposes of direct-marketing products or services nor is customer data sold, rented or leased to third parties.
I authorize the canamwalking.com software to capture and record individual and corporate aggregate data, as entered into the program by me, and acknowledge that summative information (such as steps, hydration and carbon savings data) may be shared back to my employer (excludes personal data such as passwords, email addresses, age, BMI scores, etc. which is recorded in the software but kept with strict confidentiality).

Additional Terms and Agreements

I authorize that I shall not use either Portal access or host Servers to:

Post, transmit or otherwise distribute information constituting or encouraging conduct that would constitute a criminal offense or give rise to civil liability, or otherwise use the Server in a manner which is contrary to law or would serve to restrict or inhibit any other user from using or enjoying the Server or the Internet;
Post or transmit messages constituting "spam", which includes but is not limited to unsolicited e-mail messages, inappropriate postings to news groups, false commercial messages, mail bombing or any other abuse of e-mail or news group servers;
Violate any system or network security measures including but not limited to engaging in unauthorized access or use of the Vendor’s or a third party’s network, data or information;
Post or transmit any information or software which contains a virus, "cancelbot", "trojan horse", "worm" or other harmful or disruptive component; or
Upload or download, post, publish, retrieve, transmit, or otherwise reproduce, distribute or provide access to information, software or other material which: (i) is protected by either party’s copyright or other intellectual property rights other than as authorized by this Agreement or another valid and binding agreement between the parties, is defamatory, obscene, child pornography or hate literature; or (ii) constitutes invasion of privacy, appropriation of personality, or unauthorized linking or framing.

I accept that the owner of the software has compiled the site content from sources it considers reliable. Neither the software owner nor its affiliated agents can guarantee the accuracy, completeness or fitness for any particular purpose of the site content.
I accept that the canamwalking.com software does not infringe any Canadian or United States patent, trademark, copyright or trade secret rights (i.e. Intellectual Property Rights, or “IP Rights”) of a third party and as a result, will indemnify and hold the owner of the software, their respective officers, directors, employees, agents, contractors and customers harmless from and against any and all damages, loss, costs and expenses incurred including reasonable legal fees and expenses (collectively, “Damages”) due to any claim that the canamwalking.com software infringes on any third party’s IP Rights.
I accept that canamwalking.com does not warrant or make any representations regarding the use or the results of the use of the materials in the Website or in its software in terms of their accuracy, correctness, reliability or otherwise

Applicable Law
You agree that the laws of British Columbia and Canada apply to any issue that may arise between CANAMWALKING.COM and you regarding this Website and its software, and you agree to resolve such dispute in the courts of British Columbia. You agree that regardless of any statute or law to the contrary, any claim or cause of action against CANAMWALKING.COM must be filed within one (1) year after such claim or cause of action arising or it will be forever barred.

Privacy
We take your privacy very seriously. In order for you to better understand our data collection methods, we have compiled the following list:
1. Website Forms
When you fill out a form on our website we may require you to provide your e-mail address or other information. This information is used only to contact you. We do not make this information available to any third parties.

2. Newsletter
If you elect to join our newsletters we will send you a notification approximately quarterly about new events, prizes and special offers. For your convenience, each announcement contains instructions on how to be removed from all future mailings. You may unsubscribe from our newsletters at any time and we do not make email addresses available to any third parties.

3. During Software Purchase
It is very important for us to keep accurate purchase records. During this process, we ask for information such as name, telephone, e-mail address, etc. This data is used only to identify you in order to give you the full benefits of registration including free technical support and upgrade eligibility. We do not make this information available to any third parties.

4. Cookies
Our site uses "cookies" which are small pieces of information that your browser stores on your computer's hard drive. These cookies allow you to store items in your shopping cart while browsing our web site and store the name and address that you enter on our page. The cookies are also used to identify our customers who are referred to us by one of our partners in order to compensate our partner for the referral. 6. Workplace/Group Wellness Program
If your Workplace/Group Wellness Program makes use of canamwalking.com’s tracking program, the administrator of your group may view information in your profile, including your step totals. This information is provided to them on the basis that it may not be used for any other purpose than to administer the Workplace/Group Wellness Program.
